This website and Gamer Life physical stores are operated by Gamer Life LLC. Throughout the site, the terms “we”, “us” and “our” refer to Gamer Life LLC. Gamer Life LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Any purchases for preorder/presales are subject to possible delays for any reasons that can exceed the estimated time frame. There will be no refunds or cancellations without our approval if delays do happen as all sales are final. You agree that all your payments towards any purchases is automatically forfeited to us even if you declined to accept the product or wait for the products release.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. All product photos are considered stock photos that may not be the actual product condition you receive unless noted on the picture or description.
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

In no case shall Gamer Life LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). If you decide to terminate this service, you agree that any payments for products already paid will be forfeited to us and will not be refunded to you as all sales are final even if you declined to accept the product.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 20 - LIMITED WARRANTY

• New Games, Consoles, and Accessories will typically be warrantied through the manufacturer, so be sure to contact them first.
• Preowned Games and Accessories come with a 366-day warranty and is guaranteed to work. Some rare and high value ($1000+) games are subject to exclusion or reduced warranty length and will be up to our discretion.
• Preowned Consoles come with a 366-day warranty and is guaranteed to work. Some rare and high value ($1000+) games are subject to exclusion or reduced warranty length and will be up to our discretion.
• Toys, Colectibles, Books, Cards, Music, Clothing and other items will NOT be warrantied due to the nature of its operation and use.

ALL Pre-owned video games and consoles are refurbished. We take pride in cleaning and testing all games and consoles before listing, and then refurbishing again before shipment. If there is a claim, we will thoroughly inspect & test items first, and once the claim is confirmed, we will either fix the item, exchange for the same or similar item, or refund your money. If the return item tests ok and works properly, the buyer will be responsible for return shipping to and from our location. So be sure to contact us about things to check before putting in a claim.

PLEASE DO NOT SEND AN ITEM BACK WITHOUT RETURN APPROVAL OR IT WILL BE  DENIED!

Keep in mind, that the warranty is void if the games or consoles are opened up and/or tampered with. This warranty is also void if there is any damage done due to mishandling from the buyer such as dropping it, putting any weight on it, applying or storing in extreme heat, cold, or moist conditions, striking it, water damage, cleaning with unapproved methods or solutions, etc.

We, Gamer Life LLC, reserve the right to refuse any warranty coverage for any reason deemed justified solely through us.

SECTION 21 - RETURN, REFUND, CANCELLATION POLICIES

ALL ORDERS ARE CONSIDERED FINAL! No returns, refunds or cancellations due to buyer remorse, change of mind, buyer personal and/or financial issues, manufacturing delays, etc. OFFICIALLY, NO RETURNS, REFUNDS OR CANCELLATIONS! PERIOD! HOWEVER, we may grant such a request on a case-by-case basis and will be solely up to our discretion. If the return or cancellation is approved, then all returns and cancellations are subject to a 20% restocking or cancellation fee. Buyer is also responsible for shipping.

If the item is faulty, damaged or inoperable due to our mishandling or packaging, then we will always accept the return within 30 days from the delivery date for a full refund or exchange for the same or similar priced item. Buyer will be responsible for return shipping initially, and after we receive the return and test it thoroughly, we will refund the return shipping along with any other refund or exchange. Please be sure to thoroughly clean and test your games and consoles before requesting a return. We cannot confirm all aftermarket hardware will be compatible with original hardware, so we do not provide any warranty when it comes to aftermarket hardware usage of any kind. If we find that the item is still operable, the buyer will be fully responsible for reshipping it back to their location within 30 days or the item will be discarded automatically. So please contact us for help first before deeming the item is a faulty product.

All Preowned games are cleaned and tested before listing and will be cleaned and tested before shipping out as well to help minimize returns. Please refer to our Warranty Policy page for more details.

To be eligible for a return, your item must be in the same condition that you received it, unopened or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

To start a return, you can contact us at sales@gamerlifestore.com. If your return is accepted, we’ll send you an approval notice, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Please allow a minimum of 7 business days (Mon-Fri) to process all returns.

SECTION 22 - GAMER LIFE NINJA REWARDS
Reward points are a privilege for having a customer account with Gamer Life, LLC. All reward points, discounts, and prizes can be forfeited for any reason and is up to our discretion.

We will not be responsible for any inaccuracies in spelling, point accumulation, reward costs, or any other associated issues. However, please have proof ready when messaging us for any possible corrections.

All rewards are subject to availability. All rewards and points have no cash value. Gamer Life LLC has the right to void your Ninja Rewards account, rewards, or points for any reason up to our discretion.

SECTION 23 - SHIPPING POLICY

MOST US ORDERS $49 AND ABOVE WILL RECEIVE FREE US ECONOMY SHIPPING!*

Orders will be shipped with USPS, FedEx, or UPS depending on size and weight.

All International or US purchases under $49 will be charged shipping & handling costs.

Please allow up to 4 full business (Monday-Friday) days for handling before contacting us about shipment of in-stock items.

Preorders/Presale dates are estimates and can change without notice due to any manufacturing or delivery delays or ANY other reasons.

Keep in mind, we will NOT ship any items in your order until all items are obtained. Even if those items are Preorder/Presale items that are holding back the order, we still cannot ship until the order is complete! We do not have the ability to split orders. Please make multiple orders separating In-stock items from Preorders/Presales, if necessary.

International buyers are responsible for all shipping, taxes, duties, and fees.

We cannot be responsible for shipping damages done by the shipping courier. The shipping courier will be responsible. We do however try our best to package items the best we can. Smaller single items will be bubble wrapped & card boarded and inserted into a bubble mailer. Multiple small items (if it cannot fit in a bubble mailer) or larger items will be sent out in a box and bubble wrapped.

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. WE DO NOT PROCESS RETURNS FOR DAMAGE TO BOXES/CASES/COVERS OF ANY ITEM. IF IT IS IMPORTANT TO YOU, PLEASE PURCHASE ROUTE PROTECTION. CLICK HERE TO LEARN MORE ABOUT ROUTE PROTECTION.

It is YOUR RESPONSIBILITY to keep the item and the shipping box and materials, so you can photograph/record and send us pictures/videos so we can process claims with the shipping company. If pictures/videos are not sent to us, we will DENY all returns, exchanges, or refunds!

Keep in mind we do provide shipping insurance for damage and lost packages in transit up to $200 free of charge. Any shipping losses exceeding $200 is the customer's responsibility to purchase Navidium Shipping Insurance at checkout.

We will not be responsible for any shipments undelivered due to buyer information that was inputted to the order incorrectly. We can only ship to the address on file that you, the customer has provided us. Buyers will be solely responsible for any costs for reshipments of any order.

*Excludes freight shipping and oversized packages. We'll cancel your order and refund you if your order falls in freight or oversize package categories.

SECTION 24 - TRADE-IN POLICY
By accepting ANY trade-in offers from us, whether it be store credit or cash payment, you are confirming that ALL items traded-in or sold to us were owned exclusively by you and that you are at least 18 years of age. A valid photo ID is required for all trades, no exceptions. All trade-ins are FINAL and become property of Gamer Life LLC once payment has been given in person or electronically and may not be undone for any reason after that time.

In order to receive full credit for your store credit or cash offer: ALL video game CD/DVD discs, cartridges, and accessories must be in good working condition and must include any necessary hardware that may be included originally when first sold. ALL consoles MUST include at least an audio/video cord, a power supply cord, and a minimum of 1 original brand controller. All handheld systems must include all cords and battery covers when first sold. Any items sold to us missing any or all of these components will have its value reduced accordingly and will be up to our discretion. If we deem any items being traded-in to us is not in good working condition, we have the right to refuse any items and you will be solely responsible for any costs in shipping your items back to your location. We also reserve the right to refuse ANY trade-ins for ANY reasons and you will be solely responsible for any costs in shipping your items back to your location.

SECTION 25 - REPAIRS
Gamer Life LLC and gamerlifestore.com are NOT an authorized Nintendo, Microsoft, Sony, or any other video game brand service center. If you elect to have us service your video games, consoles, and accessories, you must understand that these companies may not service your console at future dates once service has been done by us, or any third-party repair company. Using of our services may void all other warranties on the video game consoles, games, and accessories provided by Nintendo, Microsoft, Sony or any other first-party video game companies. These companies will not service video game consoles for any fee that have been serviced by companies or people other than their own service centers. We are not affiliated with Microsoft, Sony, Nintendo, SEGA, Neo Geo SNK or any other corporations. Using Gamer Life services constitutes an express waiver of your rights under those warranties and waives any liability or claim against Gamer Life LLC for voiding those warranties. Using Gamer Life Repair services also waives any liability or claim against Gamer Life LLC for any property or personal damage, loss, injury, or death at any time before, during or after repairs. Using Gamer Life Repair Services also constitutes your acceptance that you are using our services at your own personal, financial, and any other risk.

All initial repairs come with a 366-day warranty and is guaranteed to work. This 366-day limited warranty excludes any work done as a courtesy or at $0 cost labor. This 366-day limited warranty also excludes improper usage, physical damage, wear and tear, modifications, or lack of maintenance. Turnaround time could be up to 30 days depending on workload. However, Gamer Life LLC will not be liable for any turnaround times exceeding 30 days due to part shortages, equipment failures, lack of time, sickness, personal, or any other reasons.

'Size' of repair and any pricing is up to our discretion and may change at any time.

Shipping is the responsibility of customer to and from the customer's location. Customers must pay all invoices within 30 days from being invoiced and Local Pickups must be picked up by the customer within 30 days from notice of completion, otherwise, be subject to 20% interest per month and/or forfeit all items to Gamer Life LLC after 6+ months.
